If you got EditScale from the Apple App Store

  • Your agreement.

These terms are between you and us. We alone are responsible for EditScale and its content. Apple's usage rules in the Apple Media Services Terms and Conditions take precedence over any conflicting usage rules here.

  • Your license.

You receive a non-transferable license to use the app on Apple-branded products you own or control, as Apple's usage rules permit. Other accounts associated with the purchaser may also access and use it through Family Sharing or volume purchasing as those rules permit.

  • Maintenance and support.

We alone provide app maintenance and support promised by these terms or required by law. Apple has no obligation to provide maintenance or support.

  • Warranty.

We alone are responsible for any app warranty that has not been lawfully disclaimed. If the app fails to meet an applicable warranty, you may notify Apple for a refund of the app's purchase price. To the fullest extent the law permits, Apple has no other warranty obligation; all other related claims, losses, liabilities, damages, costs and expenses are our responsibility.

  • Product claims.

We are responsible for addressing your or anyone else's claims about the app or your possession or use of it, including product liability, failure to meet legal or regulatory requirements, and consumer protection, privacy or similar claims. These terms do not limit our liability beyond what the law allows.

  • Intellectual property claims.

If someone claims the app or your possession and use of it infringes their intellectual property rights, we alone are responsible for investigating, defending, settling and resolving that claim.

  • Legal compliance.

You represent and warrant that you are not in a country under a U.S. government embargo or designated by the U.S. government as supporting terrorism, and that you are not on any U.S. government list of prohibited or restricted parties.

  • Third-party terms.

When using the app, you must follow applicable third-party agreements, including your wireless service agreement.

  • Apple as beneficiary.

You and we agree that Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
